What Penders will never admit is that he's in the same boat as the devs that made Freedom Planet. As soon as he tries to make a profit off something it has to look sufficiently non-Sonic. Copyright applies to things "Fixed in a tangible medium of expression", so you can't infringe on a basic idea (like a fast anthro hedgehog), only on its design/expression. The test for infringement is roughly "could a regular person reasonably confuse the two characters". So, yeah, Scourge the Speed Demon would likely infringe on Sega's copyright since he's clearly Sonic, but the Freedom Planet characters don't.
