So far, the most we've had of old Eggman designs being used was in issue 50 with Eggman and Starline battling using his old mechs, which were still mostly Modern designs.
Most likely, they could get away with throwing in Mecha so long as he isn't directly related to anything important and never gets brought up again. Scrapnik Island probably isn't ever going to be addressed in the comic again (assuming this is all taking place in-line with the events leading up to the current arc that is), so as long as it stays a one-off they can do whatever. It could also just be them trying to milk attention from like the handful of Classicfags who still obsess over Mecha Sonic, since they're also trying to do the same with a Tails story featuring the Witchcarters the month after.
